9.2. Confidentiality. Each party agrees to use the other party's Confidential Information solely for the purposes contemplated by this Agreement, and to refrain from disclosing the other party's Confidential Information to any third-party, unless (a) any disclosure is necessary and permitted in connection with the receiving party's performance of its obligations or exercise of its rights under this Agreement or any other agreement between the parties; (b) any disclosure is required by applicable law; provided, that the receiving party uses reasonable efforts to give the disclosing party reasonable advance notice thereof so as to afford the disclosing party an opportunity to intervene and seek an order or other appropriate relief for the protection of its Confidential Information from any unauthorized use or disclosure; or (c) any disclosure is made with the consent of the disclosing party. For the purposes of this Agreement "Confidential Information" includes, without limitation, the terms of this Agreement (including pricing) and information regarding existing or contemplated service, products, advertisers, processes, techniques, or know-how, or any information or data developed pursuant to the performance of the services. Notwithstanding the foregoing, Affiliate agrees that Company may divulge its personal and/or otherwise Confidential Information to an agency, legal or regulatory authority, person or entity relating to investigations, claims or actions that Affiliate has violated this Agreement or any applicable law or regulation.
This Marketing Affiliate Agreement (the “Agreement”) is entered into this 8th day of May 2014, by and between BIRCH FIRST GLOBAL INVESTMENTS INC., a corporation incorporated in the U.S. Virgin Islands, with its main place of business located 9100 Havensight, Port of Sale, Ste. 15/16, St. Thomas, VI 0080 (referred to as “Company”) and MOUNT KNOWLEDGE HOLDINGS INC. and/or assigns, a corporation incorporated in the State of Nevada, with its main place of business located at 228 Park Avenue S. #56101 New York, NY 10003-1502 (referred to as “Marketing Affiliate” or “MA”).

Desktop tracking relies on pixels, a snippet of code that picks up the end-user’s identification, aka a cookie. Pixels rely on the user’s browser to track conversion, which is easy to set up, but on smartphones, cookies are blocked as a default setting — meaning cookies are never placed on a user’s mobile device. 1.4. Marketer shall post in a conspicuous manner on its website a privacy policy that clearly and adequately describes how consumer information is collected and used. Failure to have and maintain a privacy policy may result in termination of this Agreement.
Privacy/Data Collection. MA will at all times during the term of this Agreement maintain appropriate technical and organizational measures to protect any end-user data that it collects, accesses or processes in connection with this Agreement against unauthorized or unlawful use, disclosure, processing or alteration. MA will act only on Company's instructions in relation to the collection, use, disclosure and processing of any such end-user data, but in all instances in accordance with all applicable laws, rules and regulations.

Discounts and Coupons. You are not allowed to post any refunds, credits or discounts on the FatCow Products and Services, or other content concerning FatCow without FatCow’s prior written consent in each instance. Affiliates may only use coupons and discounts that are provided exclusively through the Affiliate Program using banners and links. Each Link connecting users of the Affiliate Site to the pertinent area of the FatCow website will in no way alter the look, feel, or functionality of the FatCow website. Any violations of the terms surrounding links, coupons, refunds, credits or discounts shall constitute a material breach of this Agreement, and may result in your termination from the Affiliate Program or the withholding of Commission Fees
3.2. Merchant.com reserves the right to terminate this Agreement and your participation in the Merchant.com Affiliate Program immediately and without notice to you should you commit fraud in your use of the Merchant.com Affiliate Program or should you abuse this program in any way. If such fraud or abuse is detected, Merchant.com shall not be liable to you for any commissions for such fraudulent sales.
As an affiliate, your marketing efforts may be for nothing if you don’t clearly understand the payment structure of your affiliate marketing agreement.  Before you jump on board, make sure the agreement specifies when, how, and why you’ll be compensated for your advertising efforts. As a merchant, a clear payment plan will ensure that your affiliates are fairly compensated, and could prevent a load of litigation down the road.

MA recognizes that the Technology in source form (code or listing) is the exclusive property of Company and/or its Affiliates and is proprietary to and the trade secret of Company and/or its Affiliates. MA agrees that it shall not, by itself or in association with any other party, reproduce, duplicate, copy, decompile, disassemble or reverse engineer the Technology in source form (code or listing) in any media.

You represent and warrant that (a) you have the authority to enter into this Agreement and sufficient rights to grant any licenses expressed herein, and (b) any material displayed on your Site will not: (i) infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or right of publicity or privacy; (ii) violate any applicable law, statute, ordinance or regulation; (iii) be defamatory or libelous; (iv) be lewd, pornographic or obscene; (v) violate any laws regarding unfair competition, anti-discrimination or false advertising; (vi) promote violence or contain hate speech; (vii) promote discrimination based on race, age, sex, religion, nationality, sexual orientation or disability; (viii) contain viruses, Trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines' or (ix) otherwise constitutes an "unsuitable Site" as determined by Brian Tracy in accordance with the terms outlined in the Section 1 above titled "Participation in the Program."
Understanding the effectiveness of your affiliate program is crucial for sustainable success. Identifying your top-performing affiliate marketers, for example, can help you double-down on what’s working. Why are they so effective? Were they very loyal to your brand before becoming an affiliate? If yes, then maybe you need to contact your most frequent shoppers about joining the program.
8.1. You are free to promote your own web sites, but naturally any promotion that mentions Merchant.com could be perceived by the public or the press as a joint effort. You should know that certain forms of advertising are always prohibited by Merchant.com. For example, advertising commonly referred to as "spamming" is unacceptable to us and could cause damage to our name. Other generally prohibited forms of advertising include the use of unsolicited commercial email (UCE), postings to non-commercial newsgroups and cross-posting to multiple newsgroups at once. In addition, you may not advertise in any way that effectively conceals or misrepresents your identity, your domain name, or your return email address. You may use mailings to customers to promote Merchant.com so long as the recipient is already a customer or subscriber of your services or web site, and recipients have the option to remove themselves from future mailings. Also, you may post to newsgroups to promote Merchant.com so long as the news group specifically welcomes commercial messages. At all times, you must clearly represent yourself and your web sites as independent from Merchant.com. If it comes to our attention that you are spamming, we will consider that cause for immediate termination of this Agreement and your participation in the Merchant.com Affiliate Program. Any pending balances owed to you will not be paid if your account is terminated due to such unacceptable advertising or solicitation.
3.2. Company actively monitors traffic for fraud. If fraud is detected, your account will be made inactive pending further investigation. Fraudulent traffic includes but is not limited to: click-through or conversion rates that are much higher than industry averages and where solid justification for such higher click-through or conversion rates is not evident to the reasonable satisfaction of Company; fraudulent leads as determined and reported by Company's clients; use of fake redirects, automated software, and/or other fraudulent mechanisms to generate payable actions from the Program, and no activity or illicit activity seen in referred accounts.
On the other hand, the report also shows that by 2020, mobile apps -- app store purchases and in-app advertising -- are expected to generate $189 billion. Although getting consumers to download and commit to your app may be difficult, there is definitely potential for earning and long-term success with apps and mobile advertising. Because of this, you should be doing everything you can to measure the success of your campaigns so that you know where to spend your marketing dollars -- and where not to.

Commissions will accrue and only become payable once you (i) provide all relevant tax and address documentation pursuant to Section 9 below and (ii) reach the Commission Threshold of $50 based on the commission rates stated on the FatCow website, solely as applied to Qualified Purchases which occurred within ninety (90) days of the end of the calendar month in which the first of such Qualified Purchases occurred. All Qualified Purchases still eligible to result in commissions under this Section 8 must remain active and in good standing pursuant to the terms of this Agreement in order to remain eligible for accrual of a commission. Once a commission has accrued under this Section 8, the amount of such commission (the “Commission Fee”) shall be due and payable to you under the terms of Section 9. FatCow reserves the right to change the Commission Threshold by amending this Agreement and will notify you for any such amendment pursuant to the terms of this Agreement.

Since the late 90s digital affiliate marketing has grown to a big industry, in 2016 US-based retailers have spent $4.7 billion on affiliate marketing. According to estimates by 2021 the affiliate marketing industry will grow to $6.8 billion. Not surprisingly, given the size of the sector, there are a lot of different affiliate marketing companies operating in various market segments.


Really interesting post from Carter. I’ve been cautious about moving into Apps, primarily because I don’t know how to make them myself and I didn’t want to get taken in by all the hype. And in Florida, Airbnb has been collaborating with a developer to build an Airbnb-branded apartment complex — one way that the company might get around some of the trickier rules regarding Airbnb rentals in private buildings, which are potentially hindering the company’s growth.

You’re obviously wondering why I pulled this app. The biggest reason is because it required a lot of upkeep based on how I built it – I had to manually update the XML and keep the installations fresh. By the end of the first week I was getting a lot of people who were pissed that the product prices weren’t accurate – when BB changes their pricing on the master XML feed, I would have to re-export it, modify it for my own structure, then upload it to my own site. We will provide all of the information necessary for you to make Links from your Affiliate Site to our site. FatCow will be solely responsible for order processing (including payment processing, cancellations, and refunds) for orders for FatCow Products and Services placed by a Referred Customer following a Link from your Affiliate Site, for tracking the volume and amount of Qualified Purchases generated by your Affiliate Site, and for providing information to Affiliates regarding Qualified Purchase statistics. 11.12. Modifications. We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on the BTI Affiliate Partner Site and giving you notice of the modification through InfusionSoft. Modifications may include, for example, changes in the scope of available referral fees, referral fee schedules, payment procedures, and Program rules.
Your acceptance of this Agreement and participation in the Affiliate Program will not violate (i) any provision of law, rule, or regulation to which you are subject, (ii) any order, judgment, or decree applicable to you or binding upon your assets or properties, (iii) any provision of your by-laws or certificate of incorporation, or (iv) any agreement or other instrument applicable to you or binding upon your assets or properties.
By quite a large margin Amazon has the largest affiliate marketing program out there, with products from more than 1.5 million sellers. Amazon has the most easy-to-use technology of all the affiliate programs I will be reviewing today. Beginners to affiliate marketing with even the most limited technical expertise will have no problems in getting up and running with the Amazon associates program, while more experienced marketers can create custom tools and websites with the APIs and advanced implementations available to them. The great thing about Amazon is that anything from kids toys to laptops can generate sales if they are purchased through any Amazon affiliate link.
Don’t expect big profits (at least not at first). While some bloggers generate a decent ancillary income from affiliate advertising, most bloggers can’t boast those kinds of results. Boosting your income through affiliate advertising takes time and practice. Don’t be afraid to test new ads, placement, and programs until you find the best mix to meet your goals for your blog.
Due to a great number of mobile apps on the market, it becomes progressively harder for app businesses to make a profit on their apps and hence finding an alternative revenue channel becomes essential. App affiliate networks allow marketers to leverage their established relationships with advertisers and get access to traffic offers in various verticals and locations. Reaching out advertisers with a specific traffic needs is a task app businesses and affiliate marketers aren’t simply capable to perform on their own effectively. It’s time-consuming and requires establishing business relationships that they don’t have time or a proper experience to establish.
Discounts and Coupons. You are not allowed to post any refunds, credits or discounts on the FatCow Products and Services, or other content concerning FatCow without FatCow’s prior written consent in each instance. Affiliates may only use coupons and discounts that are provided exclusively through the Affiliate Program using banners and links. Each Link connecting users of the Affiliate Site to the pertinent area of the FatCow website will in no way alter the look, feel, or functionality of the FatCow website. Any violations of the terms surrounding links, coupons, refunds, credits or discounts shall constitute a material breach of this Agreement, and may result in your termination from the Affiliate Program or the withholding of Commission Fees
2.7. It is entirely your responsibility to comply with all applicable intellectual property and other laws that pertain to your site. You must have express permission to use any person's copyrighted material, whether it be a writing, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person's copyrighted material or other intellectual property in violation of the law or any third party rights.

Considering that most marketing involves some form of published media, it is almost (though not entirely) redundant to call 'content marketing' anything other than simply 'marketing'. There are, of course, other forms of marketing (in-person marketing, telephone-based marketing, word of mouth marketing, etc.) where the label is more useful for identifying the type of marketing. However, even these are usually merely presenting content that they are marketing as information in a way that is different from traditional print, radio, TV, film, email, or web media.
The downside is that Shopify is only appealing for people who have physical or digital products to sell and have a need to set up a Shopify store, including site hosting, payment processing, and all the other services offered by Shopify. This can significantly narrow the appeal for this affiliate program. But if you can distinguish yourself by educating people on how to use Shopify, how it can benefit their business, and/or make them money, you could potentially big money via the affiliate program.
