After your acceptance of the terms and conditions set out in this PowerPartner™ Affiliate Marketing Agreement (Agreement), we agree to appoint you as an authorized, limited, marketing representative for ServInt (ServInt, we, us, our). This Agreement does not give you an exclusive territory. Other affiliates, resellers and agents can and will compete against you for the same or similar customers. Your customers (the Referred Customer) are free to become our direct customers. We will not directly and specifically target your customers. You agree that general advertising, if directed to more than one entity, is not specifically or directly targeting your customers. Any link or other method to sign up potential Referred Customers must require affirmative action on the part of the Referred Customer. New sign ups may not be automatically generated. The Term of this Agreement is month-to-month, and may be terminated by either party upon five business days written notice.
Force Majeure. Neither party will be responsible for failure or delay of performance if caused by: an act of war, hostility, or sabotage; act of God; electrical, internet, or telecommunication outage that is not caused by the obligated party; government restrictions; or other event outside the reasonable control of the obligated party. Each party will use reasonable efforts to mitigate the effect of a force majeure event. 

6.1. Each party owns and shall retain all right, title and interest in its names, logos, trademarks, service marks, trade dress, copyrights and proprietary technology, including, without limitation, those names, logos, trademarks, service marks, trade dress, copyrights and proprietary technology currently used or which may be developed and/or used by it in the future.12.2. We grant you a limited, revocable, non-exclusive, license to use the graphic image and text, which may include our name, logos, trademarks, service marks (collectively, the "Brian Tracy Marks"), designated in the Offer, only as provided to you through the Brian Tracy Affiliate Partnership Program and solely for the purpose of creating links from your Emails and Site to our Site pursuant to this Agreement. Except as expressly set forth in this Agreement or permitted by applicable law, you may not copy, distribute, modify, reverse engineer, or create derivative works from the same. You may not sublicense, assign or transfer any such licenses for the use of the same, and any attempt at such sublicense, assignment or transfer is void. Any prominent use of the Brian Tracy Marks on your Site must be approved by Brian Tracy prior to publishing. We may revoke your license at any time by giving you written notice.

To the extent a Marketing Affiliate transfers EU Personal Data to HubSpot and HubSpot is located in a territory outside the EU that does not provide adequate protection for Personal Data (as determined by Applicable Data Protection Law), HubSpot agrees to abide by and process such EU Personal Data in accordance with the Standard Contractual Clauses for Controllers as approved by the European Commission and available at http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32004D0915 (as amended, superseded or updated from time to time) ("Model Clauses"), which are incorporated by reference in, and form an integral part of, this Addendum. HubSpot agrees that it is a "data importer" and the Marketing Affiliate is the "data exporter" under the Model Clauses (notwithstanding that HubSpot may be an entity located outside of the EEA).

MA will act only on Company's instructions in relation to the collection, use, disclosure and processing of any such end-user data, but in all instances in accordance with all applicable laws, rules and regulations.

What’s crazy is that there really isn’t a catch. The only thing to think about is that you have to make the app more than just an XML parser like I did above because Apple has gotten very strict with their Review Guidelines – they simply won’t let this into the store any more (believe me, I’ve tried). I was lucky enough to get it in there for about a week before I pulled it (for various reasons) but definitely would have to add more functionality if I wanted to get back into this.
8.6. AWeber Affiliates are rewarded for networking and bringing in new customers through their own marketing efforts. AWeber prohibits Affiliates from utilizing their Affiliate link to refer their own customer account(s) to receive commission (“self referrals”). This also includes accounts that are not under their name but are paid for using a payment medium that they own. This includes forms of online payment (Credit/Debit cards) but also checks and money orders. Also prohibited are referrals for individuals of the Affiliate’s immediate family or household, or any other such relationship deemed problematic by the Company.

However, if you subsequently provide a sign up which leads to another Qualified Purchase on September 5th of the same year, then commissions would accrue on the latter two Qualified Purchases (i.e., the Qualified Purchases from August and September of the same year). All Qualified Purchases still eligible to result in commissions under this Section 8 must remain active and in good standing pursuant to the terms of this Agreement in order to remain eligible for accrual of a commission. Once a commission has accrued under this Section 8, the amount of such commission (the “Commission Fee”) shall be due and payable to you under the terms of Section 9. FatCow reserves the right to change the Commission Threshold by amending this Agreement and will notify you for any such amendment pursuant to the terms of this Agreement.

Desktop tracking relies on pixels, a snippet of code that picks up the end-user’s identification, aka a cookie. Pixels rely on the user’s browser to track conversion, which is easy to set up, but on smartphones, cookies are blocked as a default setting — meaning cookies are never placed on a user’s mobile device. More recently, workarounds are being created for the mobile web, but today no solution exists that allows for pixels to consistently fire into a mobile app as cookies are never used in the app world. It’s complex to find a unique identifier that can be passed back to accurately attribute.
