Subject to the terms of this Agreement and the accrual of commissions as set forth in Section 8 above, commissions will be calculated according to the specified percentage or dollar amount set forth in the commission report in your Affiliate Console for each Qualified Purchase that accrues during the period for which such commission fee is being calculated.
1.4. Marketer shall post in a conspicuous manner on its website a privacy policy that clearly and adequately describes how consumer information is collected and used. Said privacy policy must fully an accurately disclose your use of third-party technology, use of cookies and options for discontinuing use of such cookies. Failure to have and maintain a privacy policy may result in termination of this Agreement.
15.1. You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Merchant.com. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on Your Site or any other of Your Site or otherwise, that reasonably would contradict anything in this Section.
Within an affiliate agreement, the affiliate acts as an independent contractor without a joint venture or other legal entity. By signing the affiliate agreement, the affiliate acknowledges understanding of company policies indicated in the website and agrees to the outlined terms. The affiliate agreement may also require that the affiliate agree not to include any spam on the website and generally comply with federal and state anti-spam laws.

9.1. Company grants to you a non-exclusive, non-transferable, revocable right to (i) access our site through HTML links solely in accordance with the terms of this Agreement and (ii) solely in connection with such links, to use our logos, trade names, trademarks, and similar identifying material (collectively, the "Licensed Materials") that we provide to you or authorize for such purpose. You are only entitled to use the Licensed Materials to the extent that you are a member in good standing of AWeber's Affiliate Program. You agree that all uses of the Licensed Materials will be on behalf of AWeber and the goodwill associated therewith (including any data derived from the Program) will inure to the sole benefit of AWeber.
Ticketfly will process transactions placed by customers who follow Links from Affiliate’s Site to the Ticketfly Site. Ticketfly reserves the right to reject transactions that do not comply with any reasonable requirements that Ticketfly may periodically establish. Ticketfly will be responsible for all aspects of transactions processing and fulfillment. Among other things, Ticketfly will prepare order forms; process payments, cancellations, and handle customer service. Ticketfly will track transactions made with customers who purchase products using Links and generate reports summarizing this sales activity which will be available to Affiliate through the Shareasale Network. The form, content, and frequency of the reports are limited to those reports and capabilities available through the Shareasale system. Ticketfly is not responsible for any changes that Shareasale may make in their reporting format, timing, or types of reports available to members of Shareasale and the Program. To permit accurate tracking, reporting, and fee accrual, Affiliate shall ensure that Links are properly formatted. Ticketfly will not be responsible for improperly formatted Links.

2.2. As a member of Merchant.com's Affiliate Program, you will have access to Affiliate Account Manager. Here you will be able to review our Program’s details and previously-published affiliate newsletters, download HTML code (that provides for links to web pages within the Merchant.com web site) and banner creatives, browse and get tracking codes for our coupons and deals. In order for us to accurately keep track of all guest visits from your site to ours, you must use the HTML code that we provide for each banner, text link, or other affiliate link we provide you with.


FatCow reserves the right to immediately cancel or withhold for later review any Commission Fee that fails to meet the criteria of a “Qualified Purchase.” Affiliate is responsible for monitoring the payment, denial, and withholding of Commission Fees; FatCow is not obligated to actively notify Affiliates of the status of Commission Fees. If Affiliate has a question about a Commission Fee that has been cancelled or withheld, Affiliate has thirty (30) days from the day the payment would have been due to contact FatCow to request that the Commission Fee be paid. Any changes to decisions about cancelled or withheld Commission Fees are strictly made in FatCow’s sole discretion.

9.1. While that may not sound like much, affiliate marketing can be surprisingly profitable for websites that have large, committed user bases that consistently return. After all, in affiliate marketing, every person you send to a company’s website is another chance to earn a commission. So it’s in your best interest to attract as many visitors to your site as possible so you can turn the biggest profit possible.


We may modify this Agreement at any time in our sole discretion; provided that the change shall solely apply to events occurring after the date on which you accept and agree to such modifications unless you otherwise agree herein. Such modifications shall take effect when posted on our website. Modifications may include, but are not limited to, changes in the scope of available Commission Fees, commission amounts or percentages, payment procedures, Commission Fee payment schedules, and Affiliate Program rules. If any modification is unacceptable to you, your only recourse is to terminate this agreement, in which event you shall be entitled to your rights under the unmodified Agreement prior to the date of the applicable modification. Your continued participation in the Affiliate Program following our posting of any modification on our website will constitute binding acceptance of the change.

Commission Fees shall be paid based on the current information in your Affiliate profile. You are required to notify us promptly of any change in your address by updating your profile information in the Affiliate console. You are responsible for informing FatCow of your desired payment form/type. You can update or change your desired payment method at any time by updating your affiliate profile located in the affiliate console. Any changes to your desired payment method may take up to two payout cycles to take effect.
8.2. Affiliates that advertise among other keywords or exclusively bid in their pay-per-click campaigns on keywords such as AWeber, AWeber.com, www.AWeber, Awebber, and/or any misspellings or similar alterations of these - be it separately or in combination with other keywords - will be considered trademark violators, and will be terminated from AWeber's Affiliate Program. We will do everything possible to contact the Affiliate prior to the ban. However, we reserve the right to expel any trademark violator from our Affiliate Program without prior notice, and on the first occurrence of such pay-per-click bidding behavior.

If not handled carefully, affiliate marketing arrangements can inadvertently run afoul of laws regulating advertising, Internet marketing and intellectual property rights. If any legal action or proceeding is initiated, the prevailing party shall be entitled to all attorney fees, court costs, and expenses in addition to any other relief to which such prevailing party may be entitled.

Bodybuilding gives affiliates a great set of XML feeds that you can use to stream some of their best products – top 50, top 100, best sellers, etc. It has all the data for each product and automatically tags the hyperlink with your affiliate code. The only issue was that it wasn’t necessarily formatted the way I wanted it to be for the app, so I downloaded the XML, re-formatted it, and uploaded it to my own server which is where my app pulled from. You represent and warrant that: (i) you have all sufficient rights and permissions to participate in the Affiliate Program and to provision HubSpot with Affiliate Lead’s for our use in sales and marketing efforts or as otherwise set forth in this Agreement, (ii) your participation in this Affiliate Program will not conflict with any of your existing agreements or arrangements; and (iii) you own or have sufficient rights to use and to grant to us our right to use the Affiliate Marks.

You have independently evaluated the desirability of participating in the Program and are not relying on any representation, guarantee, or statement other than as set forth in this Agreement.

Desktop tracking relies on pixels, a snippet of code that picks up the end-user’s identification, aka a cookie. Pixels rely on the user’s browser to track conversion, which is easy to set up, but on smartphones, cookies are blocked as a default setting — meaning cookies are never placed on a user’s mobile device. More recently, workarounds are being created for the mobile web, but today no solution exists that allows for pixels to consistently fire into a mobile app as cookies are never used in the app world. Considering that most marketing involves some form of published media, it is almost (though not entirely) redundant to call 'content marketing' anything other than simply 'marketing'. This Agreement will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

The most well-known paper click network is Google Adwords. there is a misconception that Google does not allow any affiliate ads on its Adwords network. This is simply not true. Google does, however, have some very strict guidelines for what is acceptable. Before you get started, it is absolutely crucial that you read the Google Adwords terms and conditions. Do not skip this step. Google is known for banning people’s accounts with absolutely no warning for relatively small infractions. It’s not fun to go through the terms or conditions, but in this case, you really need to do it.

Affiliate may not in any manner misrepresent or embellish the relationship between the parties. While Ticketfly requests that Affiliate identify itself on its Site as a member of the Ticketfly Affiliate Network, Affiliate shall not otherwise engage in any promotions which name Ticketfly or imply any relationship or affiliation between the parties including, but not limited to, press releases, marketing materials, offline print advertising or marketing campaigns, media kits, screen shots, graphics altered for co-branding or any other format or media. Any such promotion will be considered grounds for immediate termination of this Agreement and may invoke further legal action.

There’s a good reason why ClickBank is still a strong contender, however it does tend to focus more on digital products which may be of questionable quality. Yes, the review process is more professional these days, but it’s still primarily focused on selling digital products, especially “how to make money” courses and the like.
