Fundraising Coach will not be liable to Marketer with respect to any subject matter in this Agreement under any contract, negligence, tort or other legal or equitable theory for any indirect, incidental, consequential, special or exemplary damages, even if Fundraising Coach has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained in the Agreement, in no event shall Fundraising Coach’s cumulative liability to Marketer arising out of or related to this Agreement, whether based in contract, negligence, strict liability, tort or other legal or equitable theory, exceed the total commission fees paid to Marketer under this Agreement.

The biggest difference is the downloads and eye balls. If you build that mobile website and just have it in cyberspace, you still need to go out and drive massive traffic to it via content, advertising, emails, partnerships, etc. When you put an app in the app store, you’re going to get a few hundred downloads in the first week (assuming it’s free and has a good marketing strategy).
Apps are critical these days, but they can also be tricky to handle. Although getting a potential customer to download an app allows for a multitude of other mobile marketing options, such as the use of push notifications and the offering of deals through the app, getting customers to actually commit to devoting space on their devices to your app is one of the biggest challenges.
New companies that don’t yet have brand recognition, clear messaging, an established business model, or a site that is converting. Affiliate marketing is not the right place to work out a company’s value proposition. Affiliates invest time and money in promoting companies and companies need to be respectful of that or they run the risk of losing those partnerships forever.

I am sick and tired of hearing some people say they never earn one dime in affiliate marketing. That’s absolutely nonsense because they’re lazy and don’t bother to do the extra work. If you’re building relationships with your target audience and affiliate managers, creating content for your site and engaging YouTube videos daily or every other day, and staying active with other marketers in the affiliate marketing community, there’s no reason for you to fail.. Simple as that!

There are three dominating business models to compare to answer this question – CPM (Cost Per Thousand), CPC (Cost Per Click) and CPA (Cost Per Action). All three are different in what is the subject to pay affiliates for – an ad view, click on an ad or specific action people do on a website or inside an app – sign up, subscribe, buy something and so on. So what model will generate more revenue for you?

5.1. Marketer shall earn a forty percent (40%) commission on sales of any Products sold through the Link, and Marketer shall earn an additional five percent (5%) commission on sales of any Product sold through a Sub-Marketer’s Link, except that Fundraising Coach is not responsible, and shall not be required to make commission payments to Marketer, in the event that said cookies are lost or destroyed in any manner, including but not limited to a user’s clearing of the cache or cookies on their web browser.
8.2. Affiliates that among other keywords or exclusively bid in their Pay-Per-Click campaigns on keywords such as merchant.com, merchant, www.merchant, www.merchant.com, and/or any misspellings or similar alterations of these – be it separately or in combination with other keywords – and do not direct the traffic from such campaigns to their own website prior to re-directing it to ours, will be considered trademark violators, and will be banned from Merchant’s Affiliate Program. We will do everything possible to contact the affiliate prior to the ban. However, we reserve the right to expel any trademark violator from our affiliate program without prior notice, and on the first occurrence of such PPC bidding behavior.

New companies that don’t yet have brand recognition, clear messaging, an established business model, or a site that is converting. Affiliate marketing is not the right place to work out a company’s value proposition. Affiliates invest time and money in promoting companies and companies need to be respectful of that or they run the risk of losing those partnerships forever. 

Considering that most marketing involves some form of published media, it is almost (though not entirely) redundant to call 'content marketing' anything other than simply 'marketing'. There are, of course, other forms of marketing (in-person marketing, telephone-based marketing, word of mouth marketing, etc.) where the label is more useful for identifying the type of marketing. However, even these are usually merely presenting content that they are marketing as information in a way that is different from traditional print, radio, TV, film, email, or web media.


Since the emergence of affiliate marketing, there has been little control over affiliate activity. Unscrupulous affiliates have used spam, false advertising, forced clicks (to get tracking cookies set on users' computers), adware, and other methods to drive traffic to their sponsors. Although many affiliate programs have terms of service that contain rules against spam, this marketing method has historically proven to attract abuse from spammers.
On the pros side of having an in-house affiliate program are such factors as having a control over the whole system, quality assurance and reducing costs if you manage to keep your affiliate program department small. On the cons side such things as it’ll take time to build a significant size affiliate base, advertising costs, potentially costly mistakes. Expect for a very few occasions when you’re launching a unique product or service and monetizing it with ads from an affiliate network may present a challenge, you better off to just sign up a reputable affiliate network.

Many laws specifically regulate the ways online ads are delivered. For example, online advertising delivered via email is more regulated than the same ad content delivered via banner ads. Affiliate understands that Ticketfly may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this Agreement or operate websites that are similar to or compete with Affiliate’s site. Affiliate has independently evaluated the desirability of participating in the Program and is not relying on any representations or statements other than as set forth in this Agreement.

For publishers and media buyers (or ‘affiliates’) CPA programs offer the ability to generate significant revenues with the right traffic.  If publishers identify traffic that converts particularly well for a certain type of offer (e.g. dating) then they can generate a much higher eCPM or overall revenue using affiliate advertising than typical cost per click based ads.  In addition, smart affiliates or media buyers can make a margin by buying traffic and optimising it to generate arbitrage between its cost and the value generated through the CPA offers.  However, achieving this can be challenging on mobile given the large number of parameters (device, operating system etc) that need to be tracked and managed.
We will provide all of the information necessary for you to make Links from your Affiliate Site to our site. FatCow will be solely responsible for order processing (including payment processing, cancellations, and refunds) for orders for FatCow Products and Services placed by a Referred Customer following a Link from your Affiliate Site, for tracking the volume and amount of Qualified Purchases generated by your Affiliate Site, and for providing information to Affiliates regarding Qualified Purchase statistics. 2.2. All Affiliates that engage in email marketing must have the consent of the recipient to send such email and shall maintain records evidencing such consent including, without limitation: (a) Subscriber opt-in date; (b) Registration source; (c) First name; (d) Last name; (e) E-mail address; (f) Privacy Policy of Source Site; (g) Any other information collected; and (h) Affiliate will supply such records to Company within one (1) business day of a request.


9.1. We grant to you a non-exclusive, non-transferable, revocable right to (i) access our site through HTML links solely in accordance with the terms of this Agreement and (ii) solely in connection with such links, to use our logos, trade names, trademarks, and similar identifying material (collectively, the "Licensed Materials") that we provide to you or authorize for such purpose. You are only entitled to use the Licensed Materials to the extent that you are a member in good standing of Merchant.com's Affiliate Program. You agree that all uses of the Licensed Materials will be on behalf of Merchant.com and the good will associated therewith will inure to the sole benefit of Merchant.com.

What’s crazy is that there really isn’t a catch. The only thing to think about is that you have to make the app more than just an XML parser like I did above because Apple has gotten very strict with their Review Guidelines – they simply won’t let this into the store any more (believe me, I’ve tried). I was lucky enough to get it in there for about a week before I pulled it (for various reasons) but definitely would have to add more functionality if I wanted to get back into this.

Yes is the short answer. Any time you are planing on generating money, you should have a plan. No plan means no real focus. There may be some 1/1000 percent of a chance you will succeed, but I haven't met them yet. If you have already started and have generated an income, record how. Doing so will give you material for use in expanding your business faster.


8.2. Affiliates that among other keywords or exclusively bid in their Pay-Per-Click campaigns on keywords such as merchant.com, merchant, www.merchant, www.merchant.com, and/or any misspellings or similar alterations of these – be it separately or in combination with other keywords – and do not direct the traffic from such campaigns to their own website prior to re-directing it to ours, will be considered trademark violators, and will be banned from Merchant’s Affiliate Program. We will do everything possible to contact the affiliate prior to the ban. However, we reserve the right to expel any trademark violator from our affiliate program without prior notice, and on the first occurrence of such PPC bidding behavior.
You grant to us a non-exclusive license to utilize your name, title, trademarks, and logos (the "Affiliate Trademarks") in any advertisement or other materials used to promote FatCow and the Affiliate Program, provided that FatCow’s use of the Affiliate Trademarks is not required and is at its sole discretion. This license shall terminate upon the termination of your participation in the Affiliate Program.
