In no event will either party be liable to the other party for any direct, indirect, special, exemplary, consequential or incidental damages arising from or related to this Agreement or the Program, even if informed of the possibility of such damages. Further, neither party's aggregate liability arising from this Agreement and the Program shall exceed the total referral fees paid or payable to you under this Agreement.
9.2. Each party agrees not to use the other's proprietary materials in any manner that is disparaging, misleading, obscene or that otherwise portrays the party in a negative light. Each party reserves all of its respective rights in the proprietary materials covered by this license. Other than the license granted in this Agreement, each party retains all right, title, and interest to its respective rights and no right, title, or interest is transferred to the other.

MA agrees that it shall not, by itself or in association with any other party, reproduce, duplicate, copy, decompile, disassemble or reverse engineer the Technology in source form (code or listing) in any media.

HomeNav will pay Affiliate Commissions during the term of this agreement. “Commissions” are an amount equal to the percentage of the aggregate Net Proceeds received by HomeNav from the sale of Qualifying Purchases actually made from the HomeNav Website for the affiliate program Affiliate signs up for. “Qualifying Purchases” means all HomeNav products and services that are purchased by users during a visit to the HomeNav Website immediately following navigation to the designated URL through a Link under this Affiliate Marketing Program. Commissions will not be payable on sales otherwise made from the HomeNav Website or other HomeNav channels, even if the customer previously made a Qualifying Purchase. “Net Proceeds” means the proceeds received by HomeNav from the sale of Qualifying Purchases on the HomeNav Website net of all returns, refunds, and allowances, less costs and expenses attributable to taxes, shipping and handling, fraud and bad debts, duties, and credit card processing. (For purposes of calculating Net Proceeds, credit card sales will be subject to a flat deduction of 3% of the sale price.)
Affiliate Training and Support.  We may make available to you, without charge, various webinars and other resources made available as part of our Affiliate Program. If we make such resources available to you, you will encourage your sales representatives and/or other relevant personnel to participate in training and/or other certifications as we recommend and may make available to you from time-to-time. We may change or discontinue any or all parts of the Affiliate Program benefits or offerings at any time without notice.
The affiliate relationship does not represent a professional or formal agreement, and as an affiliate you are not an employee of AffiliateWP, LLC. or Sandhills Development, LLC. You agree that this is not a legally binding relationship and as a result may not take legal action against AffiliateWP, LLC. and Sandhills Development, LLC. These affiliate terms and conditions are subject to change without notice.

If any modification is unacceptable to Affiliate, Affiliate’s only recourse is to terminate this agreement. Affiliate’s continued participation in the Program following our posting of a change notice or new agreement on the Ticketfly Site or the Shareasale site and/or sending you the change notice via e-mail will constitute binding acceptance of the change.

The Links will serve to identify your website as a member of the Affiliate Program and will establish a link from your website or e-mail to FatCow’s website. You agree to cooperate fully with us in order to establish and maintain such Links. You further agree that your use of the Links must be in compliance with this Agreement at all times. FatCow may modify the Links from time to time in its sole discretion. You will not use graphic or textual images (indicating a Link) or text messages to promote FatCow that are not approved in advance by FatCow. All Affiliate Sites shall display the Links prominently in relevant sections of their website. Furthermore, you agree not to use cookie stuffing techniques that set the affiliate tracking cookie without the Referred Customer's knowledge (e.g. iframe). Any information with respect to FatCow that is going to be displayed on the Affiliate Site must be preapproved by FatCow in writing.

As for now, I’m comfortable using SiteGround affiliate network and it’s pretty good actually. Their hosting service is pretty much the best considered its price. I’ve tried others but SiteGround stands out. I’ll also try new affiliate networks, something from the list you have just provided. I think Amazon is too saturated at the moment, and I need a better network. 2018 will be interesting indeed.

Subject to the terms and conditions of this Agreement, Company hereby grants to MA the right to advertise, market and sell to corporate users, government agencies and educational facilities (“Clients”) for their own internal language learning, soft skills and communication purposes only, and not for remarketing or redistribution, and not for use in a data center environment for multiple users Clients, unless otherwise agreed to by Company prior in writing, the Technology listed in Schedule A of this Agreement, and to sell and/or bundle Technology Maintenance for the Technology and to provide first line technical support and implementation services for the Technology in the territories listed in Schedule A of this Agreement, providing MA meets the criteria required for delivering services according to Schedule A.

Any attempt by an Affiliate to manipulate, falsify or inflate Referred Customers, Qualified Purchases, or Commission Fees to intentionally defraud FatCow or any violation of the terms of this Agreement constitutes immediate grounds for FatCow to terminate the Affiliates participation in the Affiliate Program and will result in the forfeiture of any Commission Fees due to the Affiliate.
