HomeNav will be solely responsible for fulfilling all orders for its products and services and payment processing, and customers who buy products and services through the Affiliate Marketing Program will be deemed customers of HomeNav. Accordingly, all rules, policies, operating procedures, and information concerning customer orders and sales will apply to those customers, including HomeNav’s rules of privacy, confidentiality, terms of use, and terms of sale. HomeNav may change its policies, operating procedures, and terms of use and sale at any time without notice to Affiliate.
As used in this agreement, “HomeNav” means HomeNav, LLC, and “Affiliate” means the affiliate or referral partner participating in the Affiliate Marketing Program. “Affiliate’s Website” individually and collectively means any or all of Affiliate’s website, email communications, and software applications. “Affiliate Marketing Program” means the program managed by or on behalf of HomeNav by which participating entities place links on their electronic properties that connect to the HomeNav Website and for which a commission is earned. The “HomeNav Website” means www.homenav.com.
Affiliate may not in any manner misrepresent or embellish the relationship between the parties. While Ticketfly requests that Affiliate identify itself on its Site as a member of the Ticketfly Affiliate Network, Affiliate shall not otherwise engage in any promotions which name Ticketfly or imply any relationship or affiliation between the parties including, but not limited to, press releases, marketing materials, offline print advertising or marketing campaigns, media kits, screen shots, graphics altered for co-branding or any other format or media. Any such promotion will be considered grounds for immediate termination of this Agreement and may invoke further legal action.

MA will at all times during the term of this Agreement maintain appropriate technical and organizational measures to protect any end-user data that it collects, accesses or processes in connection with this Agreement against unauthorized or unlawful use, disclosure, processing or alteration. MA will act only on Company's instructions in relation to the collection, use, disclosure and processing of any such end-user data, but in all instances in accordance with all applicable laws, rules and regulations.
3.1. Marketer warrants that it shall not design, or allow to be designed, its website or any other website under its control in any manner which creates the impression, or leads customers to believe, that Marketer is sponsored by, or in a legal partnership with Fundraising Coach, or tends to confuse customers in any way regarding the source of the services or products delivered thereon.
The phrase, "Affiliates are an extended sales force for your business", which is often used to explain affiliate marketing, is not completely accurate. The primary difference between the two is that affiliate marketers provide little if any influence on a possible prospect in the conversion process once that prospect is directed to the advertiser's website. The sales team of the advertiser, however, does have the control and influence up to the point where the prospect either a) signs the contract, or b) completes the purchase.

Isn´t it better to have a “responsive” website? With it you would´t only handle iPhone and perhaps Android, but also the other mobile devices. You would not have the hassle with the Apple registration and fee. And the customer does not have the hassle to download the app, instead he can straight on use the website. 1.4. Marketer shall post in a conspicuous manner on its website a privacy policy that clearly and adequately describes how consumer information is collected and used. Said privacy policy must fully an accurately disclose your use of third-party technology, use of cookies and options for discontinuing use of such cookies. Failure to have and maintain a privacy policy may result in termination of this Agreement.
Any attempt by an Affiliate to manipulate, falsify or inflate Referred Customers, Qualified Purchases, or Commission Fees to intentionally defraud FatCow or any violation of the terms of this Agreement constitutes immediate grounds for FatCow to terminate the Affiliates participation in the Affiliate Program and will result in the forfeiture of any Commission Fees due to the Affiliate.

11.6. Assignment. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent, which may be withheld in our sole discretion.
