You are only eligible to earn Commission Fees on Qualified Purchases occurring during the Term. Commission Fees earned prior to the date of termination will be eligible for commissions only if the orders for the related FatCow Products and Services are not cancelled within (30) days and comply with all of the terms of this Agreement. We may withhold your final payment of Commission Fees for a reasonable time to ensure that all Qualified Purchases are valid and payment from Referred Customers are legitimate as determined by FatCow in its sole discretion.
There is no one affiliate advertising method that will work for everyone. The vast majority of successful affiliate marketers have only become successful through testing trial and error. Do not be afraid of failure, especially what you’re new to affiliate advertising. There is a big learning curve involved. But once you master this, it is something that can make you money every single day with very little effort. Believe in yourself, keep going, and never give up. Because you can fail to follow in different times but if you succeed once your entire life could change.

The Affiliate marketing concept is simple: Brands hire affiliates, who may be bloggers, publishers, or other companies, to promote a product or service using their own blogs, websites, or social media channels. Affiliates are paid a share of any sales or a commission resulting from their efforts. Compensation for affiliates may also take the form of incentives, discounts, one-time offers, or giveaways.
Every affiliate marketing relationship between a merchant and the affiliate/content publisher is defined by an affiliate marketing agreement. Usually, the merchant creates the agreement, and affiliates agree to abide by the terms in order to participate. These agreements should include terms like (1) payment structure, (2) advertisement means and structure, and (3) cookie duration (i.e., once customers clicks the link, how soon do they need to purchase the product for the affiliate to get paid?)  In addition to laying a foundation for a business relationship, these agreements can also protect both merchants and affiliates in several ways.
Burst Media has two different programs in their network. Burst Network focuses on Target Advertising sold on a CPM basis. Non-targeted Advertising campaigns are sold at lower CPMs and include CPC ads to fill up inventory. They keep 50% of the ad revenue but offer better rates for publishers who agree to one year or three years exclusivity. Burst Direct is the other program they offer that run performance-driven campaigns. They take a much smaller cut (35%), but the revenue potential is probably more uncertain.

Unless otherwise stated in an Offer Addendum, we will pay you referral fees on a monthly basis. Approximately thirty (30) days following the end of each month, we (or our designee, InfusionSoft) will send you a check for the referral fees earned on Qualifying Product revenues for that month, less any returns and canceled orders. However, if the referral fees payable to you for any month are less than $25.00, we will hold those referral fees until the total amount due is at least $25.00 or (if earlier) until this Agreement is terminated. 

We will provide all of the information necessary for you to make Links from your Affiliate Site to our site. FatCow will be solely responsible for order processing (including payment processing, cancellations, and refunds) for orders for FatCow Products and Services placed by a Referred Customer following a Link from your Affiliate Site, for tracking the volume and amount of Qualified Purchases generated by your Affiliate Site, and for providing information to Affiliates regarding Qualified Purchase statistics. FatCow will be solely responsible for all order processing, including but not limited to payment processing, cancellations, refunds and related FatCow service.
Ticketfly will process transactions placed by customers who follow Links from Affiliate’s Site to the Ticketfly Site. Ticketfly reserves the right to reject transactions that do not comply with any reasonable requirements that Ticketfly may periodically establish. Ticketfly will be responsible for all aspects of transactions processing and fulfillment. Among other things, Ticketfly will prepare order forms; process payments, cancellations, and handle customer service. Ticketfly will track transactions made with customers who purchase products using Links and generate reports summarizing this sales activity which will be available to Affiliate through the Shareasale Network. The form, content, and frequency of the reports are limited to those reports and capabilities available through the Shareasale system. Ticketfly is not responsible for any changes that Shareasale may make in their reporting format, timing, or types of reports available to members of Shareasale and the Program. To permit accurate tracking, reporting, and fee accrual, Affiliate shall ensure that Links are properly formatted. Ticketfly will not be responsible for improperly formatted Links.

Affiliate Program Limits. Each accepted Affiliate Lead will expire according to the information provided on the Program Policies Page. from the date the Affiliate Lead clicked on the Affiliate Link that was made available by you. We will pay you Commission for each new Customer who completes a Customer Transaction after clicking on an Affiliate Lead made available by you, provided that you remain eligible to receive Commission pursuant to the terms of this Agreement.  The start of the Customer’s subscription is determined by the date of the first purchase of the Subscription Service by the Customer and you will receive a Commission payment for that Customer Transaction only, regardless of any additional purchases made by that customer during their Subscription Service. For example, if the initial Customer Transaction is for one user of Sales Hub Professional, and there is a subsequent transaction by that same customer for an additional user of Sales Hub Professional for the same subscription, Affiliate will receive Commission for the initial user purchased only. The Affiliate will not be entitled to receive Commission on any additional purchases of HubSpot Products by that same Customer
As used in this agreement, “HomeNav” means HomeNav, LLC, and “Affiliate” means the affiliate or referral partner participating in the Affiliate Marketing Program. “Affiliate’s Website” individually and collectively means any or all of Affiliate’s website, email communications, and software applications. “Affiliate Marketing Program” means the program managed by or on behalf of HomeNav by which participating entities place links on their electronic properties that connect to the HomeNav Website and for which a commission is earned. The “HomeNav Website” means www.homenav.com.
HubSpot’s Proprietary Rights.  No license to any software is granted by this Agreement. The HubSpot Products are protected by intellectual property laws. The HubSpot Products belong to and are the property of us or our licensors (if any). We retain all ownership rights in the HubSpot Products. You agree not to copy, rent, lease, sell, distribute, or create derivative works based on the HubSpot Content, or the HubSpot Products in whole or in part, by any means, except as expressly authorized in writing by us. HubSpot, the Sprocket Design, the HubSpot logos, and other marks that we use from time to time are our trademarks and you may not use them without our prior written permission, except as otherwise set forth in this Agreement.
​eCommerce has gone global and knows no borders. As a result, shoppers are more often making retail purchases from companies based outside of their own country. Borderfree Chief Strategy Officer Kris Green commented on this trend saying, “You [the consumer] don’t necessarily know or care, you just know that it’s coming to you and you know what you’re going to have to pay. I find more and more consumers just want to be able to see the price, have no surprises and will be indifferent as to where the product is coming from.”
8.5. We strongly advise Affiliates to stay compliant with the Federal Trade Commission (FTC) guidelines on testimonials and endorsements. For example, all endorsements, reviews, testimonials on AWeber's products and services, as well as relationships between other types of content websites (forums, blogs, microblogs and other Social Media channels) and AWeber must be clearly disclosed in a separate policy on the Affiliate site(s). The FTC has noted that "when there exists a connection between the endorser and the seller of the advertised product", it is imperative that such connection is "fully disclosed". FTC also scrutinizes that relationship as an endorser-sponsor arrangement, and believes that the end user has the right to understand that an endorser-sponsor relationship exists (click here for more detail). We share the concept and concern of the FTC's approach and will not tolerate any Affiliates that fail to adhere to the FTC's guidance. We reserve the right to terminate our relationship with any non-compliant Affiliates.

3.2. Merchant.com reserves the right to terminate this Agreement and your participation in the Merchant.com Affiliate Program immediately and without notice to you should you commit fraud in your use of the Merchant.com Affiliate Program or should you abuse this program in any way. If such fraud or abuse is detected, Merchant.com shall not be liable to you for any commissions for such fraudulent sales.

For example when a customer purchases on your website they are asked for a discount code.  If they didn’t get a code they may search for a discount. Discount sites rank high in search results so if you have affiliates that are discount sites, customers may visit their sites just for the discount code and then use it to purchase.  That means you pay a commission for a sale that otherwise wouldn’t qualify.
HomeNav will pay Affiliate Commissions during the term of this agreement. “Commissions” are an amount equal to the percentage of the aggregate Net Proceeds received by HomeNav from the sale of Qualifying Purchases actually made from the HomeNav Website for the affiliate program Affiliate signs up for. “Qualifying Purchases” means all HomeNav products and services that are purchased by users during a visit to the HomeNav Website immediately following navigation to the designated URL through a Link under this Affiliate Marketing Program. Commissions will not be payable on sales otherwise made from the HomeNav Website or other HomeNav channels, even if the customer previously made a Qualifying Purchase. “Net Proceeds” means the proceeds received by HomeNav from the sale of Qualifying Purchases on the HomeNav Website net of all returns, refunds, and allowances, less costs and expenses attributable to taxes, shipping and handling, fraud and bad debts, duties, and credit card processing. (For purposes of calculating Net Proceeds, credit card sales will be subject to a flat deduction of 3% of the sale price.)
11.8. Obligation to Mediate in Good Faith. Except as provided in this Section 11.7, before either party initiates a lawsuit against the other relating to this Agreement, the parties agree to mediate all disputes and claims arising out of or relating to this Agreement, the parties' performance under it, or its breach. To this end, either party may request, after informal discussions have failed to resolve a dispute or claim, that each party designate an officer or other management employee with authority to bind the party to meet in good faith and attempt to resolve the dispute or claim through mediation. During their discussions, each party will honor the other's reasonable requests for information that is not privileged and relates to the dispute or claim. This Section does not apply (i) should the expiration of the statute of limitations for a cause of action be imminent, or (ii) if a party is seeking an injunction pursuant to Section 11.8.
Subject to the limitations set forth in Section 3 above and otherwise in this Agreement, we grant you a non-exclusive, non-transferable, revocable license to (i) access our website through the Links solely in accordance with the terms of this Agreement and (ii) solely in connection with such Links, to use the FatCow trademark and logo and similar identifying material provided by us (collectively, the "Licensed Materials"), for the sole purpose of selling FatCow Products and Services on your Affiliate Site and as approved in advance by us. You may not alter, modify, or change the Licensed Materials in any way. You are only entitled to use the Licensed Materials while you are an Affiliate in good standing and in compliance with all of the terms of this Agreement.

This is both relevant and a much better user experience that feels far less like advertising.
This approach differs greatly from less savvy merchants who decide to work directly with networks in markets they do not understand or with agencies who claim to have an international presence without retaining local market knowledge, offices and staff. Merchants who opt for network managed services risk lost time, lost revenue and brand reputation damage if the network is not vigilant in understanding the culture and working with affiliates to ensure they are appropriately advertised. Networks are biased by necessity. Their interest is primarily focused on their own portfolio and recurring revenue streams. This bias can be of detriment to the growth of an affiliate channel poised to expand internationally if opportunities for increased exposure and ad placements through other platforms are ignored in favor of protecting their own bottom line.
Rather than paying for clicks and impressions, what these companies want is an overarching view of their data and costs, as well as the chance to earn incremental revenue. They are combining marketing, business development, and other partnerships that are based on cost per action and tied to their overall goals. They expect transparency, achieved through centralized reporting, automated payments, and a standard operating framework.

The best way to think about affiliate marketing is quality over quantity. All payments will be made from Fundraising Coach to Marketer via PayPal accounts. It is Marketer’s sole responsibility to maintain an active PayPal account and Fundraising Coach is not responsible for any fees charged to Marketer from PayPal.

5.1. Marketer shall earn a forty percent (40%) commission on sales of any Products sold through the Link, and Marketer shall earn an additional five percent (5%) commission on sales of any Product sold through a Sub-Marketer’s Link, except that Fundraising Coach is not responsible, and shall not be required to make commission payments to Marketer, in the event that said cookies are lost or destroyed in any manner, including but not limited to a user’s clearing of the cache or cookies on their web browser.
Within an affiliate agreement, the affiliate acts as an independent contractor without a joint venture or other legal entity. By signing the affiliate agreement, the affiliate acknowledges understanding of company policies indicated in the website and agrees to the outlined terms. The affiliate agreement may also require that the affiliate agree not to include any spam on the website and generally comply with federal and state anti-spam laws.
Of course, there can be downsides to working with affiliate marketing companies, just as there are if you work with an advertising firm or SEO agency. Partnering with a third party can be daunting at first as it may feel like you’re handing over control to someone else. There’s also the question of whether they’ll generate the results you’re looking for or fail to deliver. Likely there is an upfront investment to secure affiliate payouts (like an agency fee and your pay-out wallet in commission junction), but as we discussed above, it’s in their interest for your campaign to succeed.  Both teams have skin in the game which makes it highly unlikely that they’ll let you down especially if they have a track record of recruiting good affiliates.

One of Cyberheat’s affiliates used sexually explicit e-mails that didn’t comply with FTC warning label requirements, and the FTC tried to hold Cyberheat strictly liable for the affiliate’s actions. Although the case did not result in merchants being held strictly liable for an affiliate’s actions per se, since then, the FTC and state authorities have continued to increase affiliate monitoring requirements.

Considering that most marketing involves some form of published media, it is almost (though not entirely) redundant to call 'content marketing' anything other than simply 'marketing'. All Affiliates shall maintain and post in a conspicuous manner on any website involved in the Program a privacy policy that clearly and adequately describes how consumer information is collected and used. The privacy policy must fully and accurately disclose your use of third-party technology, use of cookies, and options for discontinuing use of such cookies. The privacy policy and data protection mechanisms used must comply with all data privacy and protection regulations which apply within the countries the Affiliate conducts business (examples include but are not limited to EU Privacy Shield, GDPR, etc.). Company reserves the right to review your privacy policy as necessary. Failure to have a privacy policy may result in termination from the Program.
6.1. Fundraising Coach makes no express or implied representations or warranties regarding Fundraising Coach’s Products or web site. Fundraising Coach makes no representation that its website(s) will be uninterrupted or otherwise error free, and Fundraising Coach will not be liable for any harm caused to Marketer as a result of an interruption or error.

TICKETFLY’S TOTAL LIABILITY TO AFFILIATE ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT IS LIMITED TO THE GREATER OF FIVE HUNDRED DOLLARS ($500) OR THE AMOUNTS PAID BY TICKETFLY TO AFFILIATE DURING THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE FIRST REOCCURRENCE OF EVENTS GIVING RISE TO THE IMPOSITION OF LIABILITY UNDER THIS AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW THE FOREGOING LIMITATIONS, SO THEY MAY NOT APPLY TO AFFILIATE.
As of today, merchants can either act as if they will be held liable for their affiliate’s actions, or be prepared for FTC litigation if an affiliate does something illegal. In order to prevent unneeded litigation, your affiliate marketing agreement should explicitly and clearly state terms about how the affiliate may and may not advertise. The agreement should also include a proper termination clause in the event a violation does occur.

Each Link connecting users of the Affiliate Site to the pertinent area of the FatCow website will in no way alter the look, feel, or functionality of the FatCow website. Any violations of the terms surrounding links, coupons, refunds, credits or discounts shall constitute a material breach of this Agreement, and may result in your termination from the Affiliate Program or the withholding of Commission Fees
Force Majeure. Neither party will be responsible for failure or delay of performance if caused by: an act of war, hostility, or sabotage; act of God; electrical, internet, or telecommunication outage that is not caused by the obligated party; government restrictions; or other event outside the reasonable control of the obligated party. Each party will use reasonable efforts to mitigate the effect of a force majeure event.
If the above locations do not yield information pertaining to affiliates, it may be the case that there exists a non-public affiliate program. Utilizing one of the common website correlation methods may provide clues about the affiliate network. The most definitive method for finding this information is to contact the website owner directly if a contact method can be located.
